Η εν λόγω δαπάνη δημιουργήθηκε σύμφωνα με τον Ν. 4412/2016, που αφορά στις δημόσιες συμβάσεις. Σύμφωνα με την Οικονομική Υπηρεσία του Δήμου Πάρου, η δαπάνη με δεδομένο ότι αφορά σε φιλοζωικό σωματείο μη κερδοσκοπικού χαρακτήρα άπτεται στις διατάξεις του Ν. 4830/2021 και όχι του Ν. 4412/2016, καθώς δεν θεωρείται «Οικονομικός Φορέας» που δύναται να συνάπτει συμβάσεις, αλλά σωματείο που μπορεί να επιχορηγείται.
Ο αναπληρωτής προϊστάμενος της Διεύθυνσης Οικονομικής Υπηρεσίας του Δήμου Πάρου, σύμφωνα με την υπ’ αρ. πρωτ. 10795/04-06-24 επιστολή – ενημέρωση προς το Σύλλογο Προστασίας Ζώων Πάρου, γνωστοποίησε πως σύμφωνα με τις κείμενες νομικές διατάξεις, η εν λόγω δαπάνη, δεν μπορεί να εκκαθαριστεί και να πληρωθεί, για λόγους νομιμότητας και κανονικότητας. Συγκεκριμένα αντιβαίνει μεταξύ άλλων, στις διατάξεις της εγκυκλίου 39937/28-04-2023 του Υπουργείου Ανάπτυξης και Επενδύσεων, όπου αναφέρει ότι, προϋπόθεση για ένα μη κερδοσκοπικό σωματείο του άρθρου 78 Α.Κ. για συμμετοχή σε διαδικασία ανάθεσης δημόσιας σύμβασης, είναι η εγγραφή του σε επαγγελματικό μητρώο και το εν λόγω σωματείο δεν είναι εγγεγραμμένο στο Γ.ΕΜ.Η. Επίσης στο προσκομισθέν δικαιολογητικό του Διαγωνισμού, στο καταστατικό του εν λόγω συλλόγου, στο άρθρο 9 δεν προβλέπονται στους πόρους του, συμβάσεις με Δημόσιο ή έσοδα από επαγγελματική δραστηριότητα, αλλά κυρίως πόροι από δωρεές και επιχορηγήσεις.
Ο Δήμαρχος Πάρου κ. Κώστας Μπιζάς, ήδη από τις 24-05-2024 απέστειλε την υπ’ αρ. πρωτ. 9283 επιστολή, στην Ειδική Γραμματεία για την Προστασία των Ζώων του Υπουργείου Εσωτερικών και στο τμήμα Αναθετουσών Αρχών και Καινοτομίας της Διεύθυνσης Σχεδιασμού, Προγραμματισμού και Υποστήριξης του Υπουργείου Ανάπτυξης, διαβιβάζοντας το ερώτημα του Προϊσταμένου Οικονομικών του Δήμου Πάρου περί νομιμότητας και κανονικότητας της δαπάνης που αφορά στην «Παροχή υπηρεσιών για τη Φιλοξενία αδέσποτων Ζώων» του Συλλόγου Προστασίας Ζώων Πάρου PAWS. Στην επιστολή (η οποία συνοδεύει το παρόν), απαριθμήθηκαν αναλυτικά οι λόγοι που οδήγησαν στην άρνηση της Οικονομικής Υπηρεσίας του Δήμου και ζητήθηκε η έγγραφη γνωμοδότηση, σχετικά με την νομιμότητα της εν λόγω δαπάνης, χωρίς ωστόσο μέχρι σήμερα να έχει δοθεί απάντηση από τις αρμόδιες υπηρεσίες των Υπουργείων.
Ο Δήμαρχος Πάρου κ. Κώστας Μπιζάς, με σχετική δήλωσή του αναφέρει:
«Σεβόμαστε την απόφαση της φιλοζωικής οργάνωσης PAWS να προσφύγει στην δικαιοσύνη.
Ο Δήμος Πάρου στηρίζεται πάντα, πάνω στις νόμιμες διαδικασίες που διέπουν την εύνομη λειτουργία των υπηρεσιών του Δήμου μας. Από την στιγμή που η προϊσταμένη του λογιστηρίου διατύπωσε διαφωνία για την πληρωμή και κατόπιν ο Προϊστάμενος της Οικονομικής Υπηρεσίας εξέδωσε άρνηση, ο Δήμος όφειλε να σεβαστεί τις σχετικές αρνητικές εισηγήσεις.
Αναγνωρίζουμε το πολύ σημαντικό έργο που επιτέλουν όλες οι φιλοζωικές οργανώσεις. Έχουμε υποχρέωση να τις στηρίζουμε, αλλά με νόμιμες και διαφανείς διαδικασίες πληρωμής, αφού πρώτα εγκριθούν από τις Υπηρεσίες του Δήμου μας.
Ο δίαυλος επικοινωνίας του Δήμου με τις φιλοζωικές οργανώσεις αλλά και τους ευαισθητοποιημένους πολίτες για τα αδέσποτα ζώα, θα είναι πάντα ανοικτός. Δεν είμαστε απέναντι στις φιλοζωικές οργανώσεις, αλλά διπλά τους, στο πλαίσιο των δυνατοτήτων μας και σεβόμενοι πάντα το γράμμα του νόμου».
Announcement regarding the expenditure related to the provision of services for the Hospitality of Stray Animals, of the Animal Protection Association of Paros PAWS
According to an announcement by the non-profit animal welfare association PAWS, which was posted on its Facebook account, we were informed that on June 21, 2024 a lawsuit was filed at the Administrative Court of Appeal of Pireaus against the Municipality of Paros, with which it demands to be paid the entire amount owed by no. contract 18646/08-11-23, up to 35,996.80 euros. A fact that we have not been officially informed about so far.
The expenditure was created in accordance with the Law 4412/2016, which concerns public contracts. However, according to the Financial Service of the Municipality of Paros, the expenditure, given that it concerns a non-profit animal welfare association, is subject to the provisions of Law 4830/2021 and not Law 4412/2016, as it is not considered an "Economic Entity" that may enter into contracts, but a union that may be subsidized.
The deputy head of the Financial Services of the Municipality of Paros, according to the no. protocol. 10795/04-06-24 letter to the Animal Protection Association of Paros, informed that according to the written legal provisions, the said expense cannot be cleared and paid, for legality and regularity reasons.
Specifically, it contravenes with, among other things, the provisions of circular 39937/28-04-2023 of the Ministry of Development and Investments, where it states that, a condition for a non-profit association of article 78 A.K. for participation in a public contract awarding process, is to be registered in a professional register and the union in question is not registered in G.EM.H. Also, in the tender documentation provided, in the articles of the association in question, in article 2, its resources do not include contracts with the State or income from professional activity, but mainly resources from donations and grants.
The Mayor of Paros, Mr. Kostas Bizas, as early as 05-24-2024 sent the under no. letter 9283, to the Special Secretariat for the Protection of Animals of the Ministry of the Interior and to the Department of Contracting Authorities and Innovation of the Department of Planning, Programming and Support of the Ministry of Development, forwarding the question of the Head of Finance of the Municipality of Paros regarding the legality and regularity of the expenditure concerning "Providing services for the Hospitality of Stray Animals" of the Paros Animal Protection Association Paws. In the letter (which is attached), the reasons that led to the refusal of the Financial Service of the Municipality were listed in detail and a written opinion was requested, regarding the legality of the expenditure, however until today, no response has been given by the competent services of the Ministries.
The Mayor of Paros, Mr. Kostas Bizas, with his relevant statement states:
«We respect the decision of the animal welfare Society, PAWS, to take legal action.
The Municipality of Paros always relies on the legal procedures that govern the proper operation of our Municipality's services. Since the head of the accounting office expressed a disagreement about the payment and then the Head of the Financial Service issued a refusal, the Municipality had to respect the relevant refusals.
We recognize the very important work that all animal welfare organizations do. We have an obligation to support them, but with legal and transparent payment procedures, after the approval of our Municipality Services.
The Municipality's channel of communication with the animal welfare organizations as well as the sensitized citizens for stray animals will always be open. We are not against the animal welfare organizations, but alongside them, within the framework of our capabilities and always respecting the letter of the law».
